STOP DEMONSTRATION, COURT TELLS NAROK OPPOSITION LEADERS

Five Narok MPs were yesterday warned by a Nairobi court against holding a demonstration in the Narok town when they turned up for the mention of their case at Milimani, Nairobi. The five are also nicknamed “Muthaiga Five” are Narok Senator Stephen Ntutu, MPs Johana Ngeno Moitalel Kenta, Korei Lemein and Patrick Ntutu.

The prosecution informed the court it received information that the MPs were planning another demonstration in Narok on April 13. The prosecution asked to be given until May 21 for police to complete investigations.

MAIDEN SPEECH BY THE HON. ELIJAH MEMUSI KANCHORY M.P. KAJIADO CENTRAL

Mr. Speaker I take this early opportunity to thank all of those who made it possible for me to be a member of this August house.

•Today would not have been possible if God had not willed it. The scripture says; “Unless the LORD builds the house, those who build it labour in vain.” Yes, we labored, but not in vain because the Lord is on our side.

•So, to God, the Almighty, the owner of time and season, we owe our
debt of gratitude for a day like this.

•I thank the Great people of Kajiado Central who stood up to a
massive barrage of propaganda, crude threats, bribery ,abuse of
power and empty promises but they still voted for the best candidate.
Indeed ours was a victory of the common man against the tyranny of
power.

•To the good people of Kajiado central goes my unflinching gratitude.
We salute your steadfastness, courage, loyalty, commitment and fierce
determination to defend your sovereign rights. You have demonstrated in this election that in a democracy, power truly belongs to the people. I am humbled and honored by your trust and abiding faith in me and my party. I pledge that your confidence in us shall never be betrayed or taken for granted.

•My heart goes out to the youth and women of Kajiado central who
irrespective of tribe, religion and social class voted overwhelmingly for
change. I shall forever remain indebted to you for your selfless
sacrifice. I assure you that I will work tirelessly to positively transform
your lives in the 2 years before the next election.

•The outcome of this election, once again, shows the unswerving
determination of our people to ensure that democracy triumphs in
Kenya. We have sent a strong signal to all and sundry that no might is
powerful enough to thwart the will of the people. This should always
strengthen our resolve to ensure that as from now on, every vote must
not only be counted but must count in this country. Nobody or party
must ever exercise power unreasonably at any level except in
accordance with the will of the people to whom sovereignty belongs.

•I pay particular tribute to the CORD fraternity led by the 3 principals.

•I salute The Rt. Hon. Raila Odinga, a man who has given 4 decades of
his life to the selfless struggle for freedom democracy equity and
justice. Mr. Odinga has overcome immense challenges and made
enormous personal sacrifices so that Kenya can be progressive,
prosperous and democratic. Mr. Odinga brought his charisma and
oratory prowess to Kajiado Central. Indeed I now know why he is
referred to as the enigma of Kenyan politics. I ask God to bless him
for all this.

•I pay tribute to His Excellency Stephen Kalonzo Musyoka a man who
exemplifies servant leadership and principled politics. I had occasion
to witness first hand his silent but steadfast commitment to principled
politics during the campaign. I also learnt a lot from the man who is
Kenya’s most accomplished diplomat who brought peace to Sudan
and Somalia. I thank him.

•I commend the Hon. Moses Masika Wetangula a steadfast and
selfless voice for equality. His courage and energy on the campaign
trail was exemplary.

•I must at this point congratulate the CORD campaign committee in
charge of my reelection. It was headed by Hon. Junet Mohammed a
fearless man who stood by me all the way, a man whose hawkeyed
watch ensured that those engaging in electoral malpractices were
arrested, a man who helped to reduce all avenues of digital rigging.
God bless you Hon Junet.

•I thank the treasurer of the CORD election committee, Dr. Evans
Kidero.His solid input and sound advice was very helpful.
•To my Governor David Nkedianye I salute you for your selfless
support. We will walk together to develop Kajiado and take it to even
greater heights.

•Mr. Speaker I thank the members of the CORD coalition who
supported me both materially and morally. Your presence before
during and after the election day was crucial to my victory. Words
cannot express my gratitude to the over 100 MP’s who left their
personal and professional engagements to campaign for me.
•Mr. Speaker I must Salute the support received from all Kenyans I
have received messages of goodwill from all corners of this country
from Lamu to Lokituang from Mumias to Mandera. I thank them I will
not let you down.

•To the members of the Maa community from as far off as Samburu
and Laikipia in the North to Narok and Arusha in the west they have
affirmed that we are a proud people who are not visitors in Kenya. We
seek to work with all Kenyans based on mutual respect and
recognition that we are masters of our own destiny we are not an
experimental ground for ideologically bankrupt parties.

I particularly recognize the efforts of the respected and visionary Maasai leader The Hon. William Ronkorua Ole Ntimama his support was much appreciated. It sent a crucial message to those who have abandonednour African culture which respects age and the elderly; it was a decisive blow on those who had the temerity to refer to Hon. Ntimama as Vasco da Gama. They now know that Ntimama still retains clout and respect. I urge them to go to Narok and seek his forgiveness before it is too late.

•As I embark on my parliamentary duties let me recognize that
democracy in Kenya cannot survive without CDF. We now see
wananchi who are not intimidated by the tyranny of power because
resources are devolved both to counties and to constituencies. The
abolition of CDF cannot be allowed to happen if we want to safeguard
democracy.

•Mr. Speaker as I embark on my parliamentary career I would like to
say that we all know of unfounded and yet to be proven allegations of
corruption and malfeasance that hang over this house. I urge
members that we should all emulate the people of Kajiado central who
refused to be swayed by money and coercion and voted with their
conscience. If a humble peasant can refuse thousands of shillings to
sell their birthright to elect a good leader I believe that members of
this house have always and will always behave in a manner above
reproach.

•As all members prepare for the future I urge them to leave a clean
and spotless record of selfless service and prudent management of
public resources.

•I thank you Madam speaker for your attention and giving me this opportunity and look forward to working with your office as embark on my nascent political career.

EIGHT THINGS TO KNOW ABOUT IMENTI CENTRAL MP EMBROILED IN RAPE CLAIMS


1. He was born on December 6, 1960; he’s 55.

2 . He is nicknamed “Livondo” by his supporters because of his flashy lifestyle similar to that of flamboyant Nairobi politician Stanley Livondo.

3. He is a director and shareholder of the Kenya Akiba Micro Finance Ltd, which was closed in 2005 at the height of the pyramid schemes crisis.

4. In May 2012, a judge ordered the Central Bank of Kenya (CBK) to pay his company Kenya Akiba Micro Finance Ltd close to Sh1 billion after the court decided that the regulator acted arbitrary in closing down the business in 2005.

5. In 2013, Mwiti was charged with inducing by deceit and trickery 12 investors to put money in the Kenya Business Community Sacco that went down with Sh780 million in 2008 following a government purge on illegal banking institutions. He was acquitted in the same year with the judge accusing investigators of leaving loose ends in their probe.

6. Lest you forgot, 20 people are said to have killed themselves after being ruined by pyramid schemes. Thousands other investors were also left destitute in the devious schemes that cumulatively cost majority poor Kenyans Sh34 billion.

7. Mwiti is not a TNA MP; he successfully vied for the Imenti Central parliamentary seat on an Aliiance Party of Kenya (APK) ticket, the ‘bus’ party headed by Meru Senator Kiraitu Murungi.

8. In November 2007, Mwiti, through his company Touchstone Developers Ltd, advanced to Igembe South MP Mithika Linturia loan of Sh12.6 million to conduct his campaigns. In 2011, Linturi paid a lump sum of Sh14 million after Mwiti moved to court seeking to attach his property.

Patrick Tutui lost To Memusi even where he casted his vote

Patrick Tutui did not only lose to ODM’s Elijah Memusi, but also lost where he cast his vote.

At Ilbisil Township Primary school, with 1,236 registered candidates and where Tutui voted, he only garnered 431 votes against Memusi’s 471. He, however, beat Memusi at the nearby Ibissil Boarding Primary School, where with 1,026 registered voters, he got 406 votes against Memusi’s 337. The centres are located in Bissil town, Tutui’s hometown. Memusi trounced Tutui in Engaboli Primary School polling station in Matapato South, where he (Memusi) cast his vote and scored 504 votes against Tutui’s 487.

Details emerging from analysis of the total votes cast also show that Tutui lost key urban and sub-urban votes, but, scored big in the rural areas. Of the five county wards; Purko, Ildamat, Dalalekutuk, Matapato North and Matapato South, Tutui carried the day in the two Matapato wards, which account for approximately 22,000 votes of the 39,000 registered voters.

In Matapato South, which includes Namanga town, Tutui scored 4,656 votes against Memusi’s 3,967 while in Matapato North, which includes his Bissil home town, he got 4,903 against Memusi’s 4,481.  But in Ildamat, which includes parts of Kajiado town, Memusi got 2,313 against Tutui’s 1,441.

In Dalalekutuk, which includes large swathes of Kajiado suburbs, Memusi again trounced him after scoring 4,055 against his 3,417. To seal his victory, Memusi beat Tutui in less populous Purko ward, scoring 1,138 votes against his 1,048.

According to the statistics, turn-out was most poor in Matapato South. Of the 11,198 registered to vote, 8,623 turned up. About 2,575 registered voters did not vote. In an interview on the eve of by-election, Tutui lamented that drought had driven potential voters from his rural strongholds to Tanzania in search of pasture and claimed the remaining rural vote was under his “lock and key.”

KILGORIS law court fine TWO MEN sh 200,000 for slaughtering ZEBRAS

Two men who were found in possession of bush meat were on Friday fined Sh200,000 each or in default be jailed for one year by a Kilgoris Court.

Mathias Juma and Vincent Oyienda were brought before Kilgoris Resident Magistrate Monica Munyendo accused of having been found with 10 Kgs of Zebra meat valued at Sh4,000 at Kilae village in Trans Mara West Sub County on
Wednesday.

The court was told that Kenya Wildlife Service officers who were on patrol, found the suspects after they received a tip off from members of the public that some suspects were in possession of bush meat .

The court was further told that when the officers carried out a search in the suspects home they found two heads belonging to zebras that were recently slaughtered. The suspects were unable to produce documents permitting them to have game meat.

Juma and Oyienda pleaded guilty to the charge. They however told the court to be lenient saying they had slaughtered the zebras because food had become expensive.

In her ruling, Munyendo said that the killing of wild animals is a serious offence as they are a source of tourist attraction and if care is not taken most of them would be extinct in future which will be detrimental to the economy.

OBEY TRAFFIC RULES OR FLY YOUR MIRAA, says NTSA

National Transport and Safety Authority (NTSA)  has issued a stern warning to Miraa transporters from the larger Meru region who flout traffic rules.

NTSA Director Mathew Munya noted with great concerns that Miraa transporters do not obey traffic rules.

He asked them to either obey traffic rules or look for alternative ways of transporting the perishable commodity, since they are notorious for breaking traffic rules, leading to road accidents.

He further said action will be taken against the matatu sacco whose vehicle was involved in Thursday morning accident along the busy Meru - Embu highway that left eight people dead and scores injured.

HEAD-ON COLLISION

The matatu is said to have been ferrying 22 passengers, which was way beyond its 14 persons capacity.

The matatu collided head-on with an oncoming miraa lorry at Gikumene in Meru County.

The NTSA director was speaking at a forum for boda-boda operators in Kangema, Murang'a.

14 other people were seriously injured in the accident and are still receiving medical attention at the Meru Level Five Hospital.

Lateness, Disloyalty will not be Tolerated in Narok County

Nearly 90 staff from Narok County government will next week receive letters of dismissal, this is according to Governor Samuel Tunai.

Ole Tunai said the workers have been fired because of several reasons ranging from absconding duty, lateness, and disloyalty to the county government.

Speaking to the press on Saturday in his office when he made reshuffles to his cabinet, Tunai said his government is paying employees more than Sh200 million per month and residents must benefit from service delivery.

"Public service workers must be loyal to the county government and the county governor. Those with loyalties elsewhere will have to leave. We cannot allow our staff to have divided loyalties," he said.

Governor Tunai said the changes were meant to enhance service delivery and efficiency. Tunai said laxity will not be tolerated in the county government and warned staff against engaging in partisan politics.

"We have received complaints from members of the public. These changes affect some of our CECs and 22 chief officers," he said.

Public Works Roads and Transport CEC Nelson Ole Keshei replaced Allan Twala at the Tourism and Wildlife docket.

Mr Twala was moved to Lands, Housing and Urban Development replacing Morgan Siloma. Mr Siloma replaced Mr Keshei in the Public Works docket.

Ms Rebecca Nkowua was moved from the ICT docket to replace Vivian Sereti at the Water, Energy, Environment and Natural Resources Ministry. Ms Sereti moves to the Health department.

Mr Ezekiel Ronoh who was in charge of Education, Sports, Culture and Social services has been moved to the newly created docket of Administration, Coordination of Decentralization and Disaster Management. He has been replaced by John Marindany who was in charge of Health.

Finance and Economics Planning head Lena Munge and her Agriculture, Livestock, and Fisheries counterpart Richard Birir were not affected by the changes.

A case barring JAP candidate Patrick Tutui Flops

High Court has declined to bar JAP from participating in Kajiado Central by-election.

Judge Isaac Lenaola said there was nothing to stop the new party as they had already nominated a candidate. Lenaola said the people of Kajiado would suffer more if the party is stopped from participating in the by-election.

A voter had gone to court to stop the candidacy of Jubilee Alliance Party( JAP) Kajiado Central by election candidate Patrick Tutui.

The voter, applied at the High Court saying that the party cannot field a candidate in the by-election because it was not duly registered.

KENYANS trust County Chiefs more than MCAs

A large percentage of Kenyans trust governors more than the county assemblies, a new survey shows.

The research by University of Nairobi's Institute for Development Studies and department of Political Science says governors attract high confidence levels, with the trust ratings higher in rural counties and lower in the urban ones.

"A majority of Kenyans have a confidence in their county leadership and approve of their performance," IDS director Winnie Mitullah said.

The research, carried out on behalf of Afrobarometer, sampled 2,397 Kenyans between November 12 and December 5 last year. Sixty-two per cent of rural and 54 urban respondents expressed satisfaction with their governors.

County assemblies in urban areas scored 45 per cent and 54 per cent ratings putting the aggregate approval ratings for governors at 59 per cent and assemblies 51 per cent. The survey shows that performance governors stands at 61 per cent compared to 55 per cent of MCAs.

MPs Unanimously voted to CUT SRC Budget by half

The National Assembly yesterday unanimously voted to slash the 2015-16 budget for the Salaries and Remuneration Commission by more than
half.

The proposal, made by Kanduyi MP Wafula Wamunyinyi, was supported by all MPs present. They said the money allocated was not commensurate with the commission's output.

The National Treasury will be required to allocate Sh219.4 million instead of the Sh476 million it had proposed in the Budget Policy Statement.

Moving the amendment, Wamunyinyi said slashing the budget would aid the country's austerity measures as the commission has little to do.

"The commission is made up of experts and has no business hiring more to fulfill its mandate," he said.

Seconding the motion, Leader of Majority Aden Duale said it is necessary to ensure constitutional commissions operate within reasonable monetary means.

Message to my People of Kilgoris Central Ward

Everyone understands the need for change in the abstract, but on the day-to-day level people are creatures of habit. Too much innovation is traumatic, and will lead to revolt. If you are new to a position of power, or an outsider trying to build a power base, make a show of respecting the old way of doing things. If change is necessary, make it feel like a gentle improvement on the past.

Although times and people change, let us examine a few of the oppressive realities that endure, and the opportunities for power they provide:

The Reality : Change is slow and gradual. It requires hard work, a bit of luck, a fair amount of self-sacrifice, and a lot ofnpatience.

The Fantasy : A sudden transformation will bring a total change in one's fortunes, bypassing work, luck, self-sacrifice, and time in one fantastic stroke. Promise a great and total change—from poor to rich, sickness to health, misery to ecstasy—and you will have followers.

The Reality : The social realm has hard-set codes and boundaries. We understand these limits and know that we have to move within the same familiar circles, day in and day out.

The Fantasy : We can enter a totally new world with different codes and the promise of adventure. To bring power, fantasy must remain to some degree unrealized, literally unreal.

The Reality : Society is fragmented and full of conflict.

The Fantasy : People can come together in a mystical union of souls.

· Promise such a union and you can gain much power, but it is a dangerous power that can easily turn against you. This is a fantasy for demagogues to play on.

The Reality : Death. The dead cannot be brought back, the past cannot be changed.

The Fantasy : A sudden reversal of this intolerable fact. Something seems real precisely because the public and the experts as well, so desperately want to believe they are.

The key to fantasy is distance.

RECRUITMENT OF RANGERS to start on 16 march, 2015

RECRUITMENT OF RANGERS

Kenya Wildlife Service (KWS) is a State
Corporation whose responsibility is to
manage and conserve wildlife in Kenya as
provided for under the Wildlife Conservation
and Management Act, 2013. The Service
operates in harsh, remote and hostile climatic
environment and wishes to recruit men and
women who can endure these conditions for
training and deployment in various conservation
areas as Rangers in response to the wildlife
security challenges currently being
experienced in the country.

Successful candidates will undergo a mandatory
basic intensive paramilitary
training at the KWS Law Enforcement Academy –
Manyani before posting to the field for Park and
Security operations.

Interested candidates who meet the following requirements are requested to
present themselves at the respective Recruitment Centres:-

Requirements

• Must be a Kenyan citizen
• Must hail from within the County of
recruitment.
• Aged- between 18 and 25 years
• Maximum KCSE mean grade “D +” (Plus)
• Be physically fit
• Must have no criminal record
• Candidates must be in possession of Original
Certificates, National ID Card
• Candidates must turn up in appropriate
running gear It should also be noted as follows:-
• The recruitment will be conducted only in the
designated recruitment centers
and dates by a team of Kenya Wildlife Service
Officers appointed by the Director General and
issued with special identification cards.
• The recruitment shall reflect the regional
diversity of the Kenyan people
• The entire exercise will be conducted
transparently and the successful candidates will
be issued with recruitment cards.
• Any person presenting him/herself for
recruitment purposes with fake/falsified
identity cards, certificates or caught engaging in
any corrupt activity shall be arrested and
prosecuted.
• The recruitment exercise is absolutely FREE OF
CHARGE and Kenya Wildlife
Service will not be responsible for any
recruitment conducted outside
guidelines stated herein.

Who Is Who in Narok County??

Who is who in Narok County

1. Samuel ole Tunai

Born in 1968, he is the Governor. The  former spy master clinched the seat on
a United Republican Party (URP) ticket in the 2013 General Elections. After
pursuing a degree in Public Administration and International Relations at the University of Nairobi, he served in the civil service before venturing into business. He has interests in livestock farming, tourism, agriculture and real estate.

2. Hassan ole Kamwaro

Former Transport Licensing Board (TLB) and Narok County Council chairman. He is now a member of the Maasai Council of Elders.

3. Agnes Pareiyo

She is a women’s rights activist, politician and founder of Tasaru
Ntomonok Rescue Centre for young girls. Born in 1956, she has been a nominated and an elected councillor in the defunct Narok County Council. Pareiyo was named the United Nations in Kenya Person of the Year in 2005, for her work in achieving gender equality and empowerment of women. She
unsuccessfully vied for the County Women’s Representative seat in the last
election.

4. Harun Lempaka

A prominent businessman in Narok town. The former provincial administration officer entered politics in 1992 on Ford-Asili party ticket where he was its national treasurer to contest for the Narok North seat. He was defeated by former minister William Ntimama. In 2013, Lempaka, also a farmer, unsuccessfully contested for the newly created Narok East parliamentary seat on The National
Alliance (TNA) ticket.

5. Kijabe ole Tunai

The Governor’s uncle. Like the nephew,
he has interests in the hotel industry
and he is an influential person who
keeps tabs on whatever happens in the
county through his closely-knit
intelligence network.

6. Stephen ole Ntutu

A son of a powerful and an influential Maasai Senior Chief, Lerionka ole Ntutu.
Now a Senator, he previously served as the Narok South MP for 10 years.

7. Lidya Masikonde

She is Ntimama’s daughter. In 2008, she was nominated as a councillor in the
defunct Narok County Council before she unsuccessfully vied for the county
Women’s Representative seat in the 2013 General Election.

8. Stanley Koriata

A former senior chief. He is the largest land owner with more than 45,000 acres
of land in the county. He served for several years as a Permanent Secretary
(PS) in various ministries in past regimes.

10. Evelyn Aruasa

She is the Deputy Governor. She commands respect and following among
the members of the Kipsigis community.

11. Gideon Sitelu Konchella

A former army colonel, he is the Kilgoris MP. He was a Cabinet minister in retired President Mwai Kibaki’s regime.

12. Nick Kamwaro
The Speaker of the Narok County Assembly.

13. Stephen Kudate
Majority Leader in the Narok county.

14. Bob Maren

Minority Leader Narok county Assembly.

15. Moitalel ole Kenta

Teacher rapes pupil in school compound in

Wednesday, March 04, 2015 - A Primary school teacher from Narok was arrested yesterday forbdefiling a pupil within the school compound.

The Sirua Aulo teacher defiled the Class Seven pupil on Monday after luring her into his house with water. The 39 year old teacher asked the girl to fetch water for him and when she took it to his house, he asked her for s*x.

The victim told the police that the teacher told her not to scream because she is a big girl and understands ‘these things’. He promised her fair treatment at school and less punishment.

Another teacher however saw the young girl sneaking out of the suspect’s house and questioned her about her visit to the teacher who stayed alone. She told him everything and the teacher reported the matter to the headteacher.

The teacher was arrested on Tuesday evening and is locked up at Lolgorian Police Station waiting to be charged in court.

REJECT ARROGANCE AT WORK

In one of his laugh-a-minute skits, American humorist Mark Twain reminds us of something we should already know from both Ecclesiastes the Preacher and William Shakespeare’s Hamlet.

It is that, although wisdom always cries out in the street, nobody ever regards it. But, clearly, Kenya’s county chiefs are anything but wise.

Were our county governors sagacious, they would know a hundred times better than to constantly and noisily call the public’s attention to themselves by swaggering in borrowed clothing which — as the great English Bard points out in another tragic play — hangs loose upon each of them “… like a giant’s robe upon a dwarfish thief …”

That is the question. In exactly what way do our county chiefs excel? The answer depends, of course, on what you mean by that verb.

Coming from the Latin excellere, it means to be outstandingly good at your work, to surpass all your competitors in a given task, to perform better than everybody else in your category of service.

Do our county governors excel? Is that why every one of them demands to be called “Your Excellency”? Do they perform better and with greater moral vision and sense of proportion than all of Kenya’s other administrative officials — all the way from the President to the filing clerk and the office cleaner?

Yes, of course, they excel in many things. In the field of grubbing, I know no caterpillar more excellent. In the arena of disrespect for accounting, no jackdaw has ever coped. In the field of strutting, the tausi (peacock) in your garden is far too drab. As a braggadocio, Kenneth Grahame’s Mister Toad was but a debutant.

Blaise Pascal — I think it was — who noticed that, at each meal-time, it takes “more than a little” (plus q’un petit) to fill a European monarch’s belly.

But, even when spurred by the voluptuous Marie Antoinette — the nationally loathed Autrichienne — King Louis could not compete with any of modern Kenya’s county administrators.

The governor is veritably excellent. He excels not only at the “talk show” but also, much more importantly, up-table in the dining room.

There is thus no denying the excellence of His Excellency. And I say “His” only because I am not aware of any woman in the sanctum sanctorum of the headquarters of any county.

What can be denied — and must be condemned — is only the county chief’s shameless parading as a manifestation of excellence his own daily attempt to equate his greed and showmanship with the interests of those who voted him into office. Does your governor excel?

Is he characterised by abnegation, selflessness, moderation both in language and at work? Does he excellently demonstrate intellectual ability, social knowledge, technical skill and the human warmth necessary in imparting these? In short, would you gladly choose the governor as your role model?

What has he recently said or done in the political arena that, to your mind, might rapidly help the county’s mass out of its perpetual smarting in penury?

Can you remember any initiative he has recently taken to ensure that all parents in the county can feed and clothe their children and take them to school and hospital?

If not, doesn’t it raise questions in your head that, at the same time as your conditions are sinking, the governor’s family resides in a house looking like Elizabeth Regina’s palace; he drives a car more sinuous than Phoebus Apollo’s; his family eats four square meals a day; and his son probably attends an aristocratic school in England?

The only reason he demands the epithet “His Excellency” is that he shares the title governor with a Caucasian tyrant of colonial infamy once upon a time imposed on Kenya by another world.

That is why Kenyans must reject this bloated arrogance by individuals whose excellence lies only in their ability to grub.

CHALLENGES FACING TRADE UNIONS IN KENYA


*CHAPTER ONE: INTRODUCTION*
*1.1*
*Background of the study*
Employee relations consist of all those areas of
human resource management
that involve
management of relationships with employees-
directly or where trade unions
are
recognised (Bridgford and Sterling, 1991). The
relationship concerns terms
and
conditions of employment and other issues arising
from employment.
According to
Ferner and Hyman (1992), employee relations
practices include processes,
procedures
and channels of communication; the employment
policies and practices; the
development, negotiation and application of
formal systems, rules and
procedures for
collective bargaining, handling disputes and
regulating employment; and
policies and
practices for employee involvement and
communications.
A feature of the employee relations literature has
undergone extensive
change (Baglioni,
1990). Due *et al *(1991) observed that the last
decade witnessed large
scale movement in
the social, political, legal and economic climate of
many countries,
resulting in changes
in the nature of the relationship between
governments, businesses and trade
unions. The
transformation of the various sectors of the
economy has fundamental
consequences for
those working within them. According to Osbourne
and Gaebler (1992), forms
of
privatization, the adoption of quality management
systems, the
decentralization of service
delivery, the adoption of new accounting regimes,
and increasingly
individualized forms
of management impact upon the way people are
managed. Since the 1970s there
has been
a decline in trade union organization within the
Organization for Economic
Co-operation
and Development (OECD) countries, which is
causing some concern among trade
unions
(Bach and Della Rocca, 2000).

*1.1.1 Employee relations in Kenya*
The origin of employee relations system in Kenya
is traced back to the
struggle for
independence, Trade unions’ participation in the
struggle for independence,
made them
be considered organizations that have the capacity
to organize people, a
capacity many
governments would wish to control and keep
checked. The presence of an
authoritarian
government has also affected the employee
relations system in Kenya, the
government
ensured that trade unions did not indulge in
“political activities”. The
unions were
controlled so as to prevent them from emerging as
a force in opposition to
the
government (Mutunga, 2006).
The core of employee relations is the ability of
management and unions to
negotiate
terms and conditions of employment relatively free
of state control or
intervention. In
Kenya this freedom has been relatively less with
the state exercising
control through the
Ministry of Labor and the industrial court. This
influence by government in
employee
relations has been prompted by the states
involvement in business and the
fact that the
state is the single largest employer.
*1.1.2 Trade unions*
A trade union is an organization of workers who
have joined together so as
to try to
improve their interest (Moraa 2006). A trade union
would try to improve
their members’
welfare and regulate the relationship between the
workers and employers.
According to
Cole, a trade union is an association of workers in
one or more
occupations. An

association carried out mainly to advance their
members interests in
connection with their
daily work.
According to Moraa (2006), trade union movement
in Kenya started long before
independence and was involved in the fight
against colonialism. Trade
unionism became
little less than a crusade in Kenya after the II
world war. From the
hesitant beginning in
1950’s and nationalization action in the early
1950’s, to growth and
consolidation in the
1950’s and 1960’s, trade unions in Kenya have
paralleled and greatly
contributed to
nationalism and the realization of an independent
republic under majority
rule. During
the darkest days in the 1950’s it was the trade
union movement which
occupied the center
of the political stage.
According to Okumbe (2001) after Kenya became
independent, trade unions
struggled to
find their role in the new nation, the
disagreements within the trade union
movement
grew within Kenya Federations of Labor (KFL).
Moraa (2006) ascertains that
the recent
legislation and establishment of Central
Organization of Trade Unions has
substantially
restricted the independence of trade unions in
Kenya. Although there is
little government
intervention in the administration either of
Central Organization of Trade
Unions or
individual unions, there is significant government
control over both trade
union structure
and the settlement of industrial disputes through
the Ministry of Labor
(Okumbe, 2001).
There are various types of trade unions in Kenya
each representing a
particular group, for
instance; Craft Trade Union, these consist of skilled
workers who pursue
the same craft.
Originally unions were exclusively for worker who
had acquired their skills
through

traditional apprenticeship like carpenters, masons
etc in Kenya we have
Amalgamated
Union of Kenya Metal Workers. Industrial Unions
which are organized in
particular
industries irrespective of craft, trade, occupational
skills or the grade
of the members. In
Kenya trade unions are industry based, they are
mostly organized on an
industry wide
basis, they include Kenya Chemical & Allied
Workers Union and Kenya Union of
Commercial, Food and Allied Workers. General
Unions, which bring together
all
categories of workers across a range of industries
regardless of craft,
industry or
occupation. They are mostly of these occupations
which cannot be easily
defined as
either craft or industrial like the Kenya Building,
Construction, Timber,
Furniture and
Allied Trades Employees Union. Occupational
Unions that are basically
concerned with
organizing technical, clerical, professional,
supervisory and managerial
staff separately
from other workers e.g. Banking Insurance and
Finance Union Kenya.
*1.1.3 Challenges facing trade unions*
There are many challenges facing trade unions in
their day to day
operations. Workers’
organizations are experiencing serious difficulties
almost everywhere and
are losing
members. Few countries have unionization rates
above 50 percent, while
others have less
than 20 percent of non-agricultural workers in
unions. The Kenyan economy
is largely
agricultural based and therefore the working class
has been small. This has
adversely
affected potential membership of unions and their
capacity to bargain with
employers on
equal terms.
(Mutunga 2006) contents that without job security
and with high
unemployment, the result of course is that labor is
cheaper and workers are
hired and
fired at will. Along with this, unions are
undermined, not to mention the
phenomenon of
more and more cases of gross violation of labor
rights and out right union
busting.

The government and employers look down upon
trade unions and preconceive
them as
chaotic and irresponsible organizations whose
major aim is to disrupt
peace, order and
good governance, this perception attracts
government and employers into
affairs and
activities of trade unions and thus tempts the
government and employers to
control trade
unions activities. Political interference and
intimidation has been a
feature of the Kenya
industrial relations system. The activities of trade
unions have
occasionally attracted the
attention of the political establishments. At times
there has been no clear
difference
between trade union leadership and the political
leadership. Trade union
officials have at
times doubled as politicians and vice versa and this
had tended to be
prejudicial to trade
unionism. Ghai and McAuslan (1970) argue that the
legal status of Central
Organization
of Trade Unions is that of an independently
registered trade union
federation but actions
of the government have appeared at times to
assume it as an adjunct to the
administration.
Trade unions activities in Kenya have therefore not
been clearly divorced
from the
politics of the day.
Kenya has not been left out and has been affected
by globalization. Kenya
liberalized her
economy in 1994 and implemented structural
adjustment programmed prescribed
by the
World Bank and the international monetary fund.
Consequently, through the
Finance Act
No. 4 of 1994 an amendment was introduced to the
employment act. The
amendment
was on regulation of union involvement in
declaring workers redundant and
related
safeguards and procedures. This introduced the
concept of retrenchment
which the law
gives unions no role to play and the benefits
payable are left to the whims
of the
employer. One of the trade unions objectives is to
fight for job security
and workers

benefits therefore; legislations such as amendment
No. 4 of 1994 that was
introduced
when Kenya liberalized her economy adversely
affect the role and
effectiveness of trade
unions.
The trade unions are increasingly faced with
financial constraints
emanating from the
following factors, among others: loss of members
as a result of
organizational
restructuring, leading to loss of revenue since trade
unions depend on
members’
contributions in order to undertake their
operations; splitting of the of
the trade unions,
for instance Kenya Union of Post Primary
Education Teachers from Kenya
Nations
Union of Teachers, thus reducing the financial base
from membership
contributions; and
mismanagement of funds by the union leaders
(Central Organization of Trade
Unions,
2009).
Interventions to the factors above include the
growing perception that
labor will have to
develop new strategies, including strategies that
complement local
organizing with
international campaigns (Tilly 1995). But it is less
clear what sorts of
international
campaigns will be the most effective. Several new
strategies are emerging
or evolving
from old strategies. Targeting multinational
corporations is an old
strategy but it may be
taking on new forms, particularly when combined
with consumer activism
(Anner 2001).
Codes of conduct and private monitoring
mechanisms have offered yet another
albeit
controversial venue (Fung, O’Rourke, and Sabel
2000). Experience has
demonstrated
that as with all organizations, trade unions are
sensitive to wider issues
and events,
particularly labor market changes and the impacts
of neo-liberal state
policies. Such
developments heralded a necessity for trade unions
to adopt measures of
organizational

change, in order to identify means for reform and
revitalization. (Wills,
2001). According
to Hoque and Rahman (1999), because of the fact
that trade union movements
represent a
majority segment of the society, they contribute to
the socio-economic
development of
the country.
*1.1.4 Trade unions in Kenya*
There are 40 registered trade unions in Kenya;
with 32 of them being
affiliated to the
Central Organization of Trade Unions and have a
total membership of
400,000, they
include: Banking Insurance & Finance Union (K)
(BIFU), Transport & Allied
Workers
Union (TAWU), Railways Workers Union (RAWU),
Kenya Local Government Workers
Union (KLGWU) University Academic Staff Union
(UASU) etc, and Kenya National
Union of Teachers (KNUT), Union of Kenya Civil
Servants, and Kenya Union of
Post
Primary Education Teachers (KUPPET) who are not
affiliates of Central
Organization of
Trade Unions. Central Organization of Trade
Unions was established in 1965
as the sole
national trade union federation, affiliated to the
International
Confederation of Free Trade
Unions (ICFTU) and represents some 300,000
workers. (Registrar of Trade
Unions 2010)
Of the eight ILO conventions only convention 87 on
freedom of association
has not been
ratified by Kenya. The Constitution of the Republic
of Kenya Chapter IV,
36. (I) states,
“Every person has the right to freedom of
association, which includes the
right to form,
join or participate in the activities of an
association of any kind”. The
Industrial Relations
Charter, executed by the Government, the Central
Organization of Trade
Unions
(COTU), and the Federation of Kenya Employers
(FKE), gives workers the
right to
engage in legitimate trade union organizational
activities; this is
regulated by The Labor

Relations Act 2007 which regulates the formation
and management of trade
unions and
employer organizations.
*1.2*
*Statement of the problem*
Turner (1966) argued that despite the importance
of collective bargaining,
industrial
peace and harmony has been elusive as trade
union activities are met with
hostility,
retrenchment of workers has also become an
everyday practice; workers are
paid poorly
and work in poor conditions even though they are
unionized. Trade unions
have over the
years found external challenges of globalization,
increased international
competition,
technological change and the de-centralization of
collective bargaining.
Among the
consequences of such changes has been a marked
decline in union density
across most
industrialized societies (Undy, 2008). He observed
that various strategies
have been
adopted by trade unions, including mergers, in the
hope of improving union
behavior.
The activities of trade unions in Kenya are affected
by many factors both
internal and
external. These factors include national and
international laws and
policies of countries
of origin here the corporations operating in the
country come from. Trade
unions have to
adapt to the rapid changing global environment as
well as articulate
members interests, in
the face of challenges posed by national,
international laws and global
human resource
policies. The trade unions also have to manage
challenges posed by the
effects of
globalization and liberalization of the economy.
There have been few studies of an empirical nature
which sought to
determine the
challenges faced by trade unions and evaluated the
effectiveness of the
strategies used to

address the challenges. Studies related to human
relations challenges in
Kenya that are
relevant to this research include those of Mutunga
(2006) investigated the
response of
trade unions to challenges posed by conditions of
work at the Export
Processing Zone.;
Gichira (2007) investigated the challenges of
globalization and their
impact on Kenya
airways; Chumo (2007) undertook a study on the
human resource challenges
arising from
use of temporary employees; a case study of Kenya
Power and Lighting
Company;
Thathi (2008) investigated the human resource
management challenges facing
Kenya
pipeline company in the implementation of
enterprise resource planning.
Njihia (2002)
carried out a survey of women’s participation in
trade unions in Kenya.
Machyo (2003)
undertook an analysis of women’s participation in
Trade Union leadership in
Kenya.;
Businienei (2005) undertook a study of the
moderating effects of Trade Union
membership on employee perceptions of job
security and fair treatment by
management
in the manufacturing industry in Kenya; None of
the above studies focused
on the
challenges facing trade unions in Kenya. This study
therefore seeks to
address the
knowledge gap.

*Importance of the study*
It is hoped that the research findings of the
proposed study will be
beneficial to various
stakeholders, including the following:

The management of the various trade unions will
gain a better understanding
of
the challenges faced by trade unions in Kenya. On
the basis of the findings
of the
study, the leadership of the various trade unions
are expected to implement
measures that could address the identified
challenges from an informed
position
for the benefit of key stakeholders.
(ii)
The policy makers in the Ministry of Labor and
Human Resources, which is
charged with the responsibility of managing the
human resources will gain
insight
into the challenges faced by the trade unions in
Kenya and accommodate the
possible interventions that could be employed to
enhance the unions’
effectiveness in the policies to be formulated.
(iii)
The challenges facing trade unions in Kenya is an
area that is
understudied. The
proposed study is expected to make a significant
contribution to the
growing body
of knowledge in the area of trade unionism. It is
anticipated that the
findings will
be used as a source of reference by other
researchers.

One killed after strong winds destroy tent during Ruto's Kajiado Central campaigns

One person was killed and several others injured when strong
winds destroyed tents during campaigns for JAP Kajiado
Central MP candidate Patrick Tutui.

The tent reportedly fell on a crowd listening to a speech during
the rally held by Deputy President William Ruto in Kajiado on
Monday.

Police said those injured were rushed to Kajiado county
hospital and the dead to Ngatata Health Centre mortuary.
Tutui will vie against ODM Candidate Elijah Memusi in the
March 16 by-election.

Ruto will use the by-election to test his grip on the expansive
Rift Valley constituency ahead of the 2017 general election.
He has camped in the constituency for the last two weeks,
campaigning for Tutui.

Ruto is also set to test the waters for the proposed merger
between his URP and President Uhuru Kenyatta's TNA, even
as he moves to reassure his support base of a stable
relationship in the ruling Jubilee alliance.

His critics have questioned the rationale for the merger that
will see the formation of a single political vehicle ahead of

Ugandan President Museveni Replaces Finance, Security Ministers

Ugandan President Yoweri Museveni replaced his finance, security and transport ministers in a reshuffle on Sunday, which analysts said was aimed at rewarding his allies ahead of an election due early next year.

Museveni, in power since 1986, is widely expected to seek re-election. He has been under mounting pressure from local and international critics who accuse him of failing to tame pervasive corruption and for seeking to hold onto the presidency for as long as possible.

The president is voted in for a five-year term but there are no limits on how many terms he can serve.

In the reshuffle, Matia Kasaija, a junior finance minister was promoted to finance minister, replacing Maria Kiwanuka, who will become senior presidential adviser for finance.

Charles Rwomushana, a political analyst, said the changes were also aimed at bringing politicians seen as sympathetic to Museveni's former prime minister, Amama Mbabazi, into the cabinet.

Mbabazi is widely expected to stand against Museveni in next year's election.

"The two key objectives of the reshuffle were to show that loyalty pays and also to offer opportunity to those who might defect to Mbabazi," Rwomushana said.

The electoral commission has yet to set an exact date for the election.

SAFARICOM to withdraw rugby, athletics and football funding

Safaricom chief executive Bob Collymore says his company
will pull out of all sponsorship deals with three federations in
Kenya, denying them hundreds of millions of shillings in
funding.

Mr Collymore plans to cut off the football, athletics and rugby
federations, which have been marred by controversies and
claims of corruption that have led to a push for a regime
change to reform the three sectors.

Speaking exclusively to Business Daily , Collymore said that
the lack of transparency has dented the image of football,
athletics and rugby management and they have to put their
houses in order.

Safaricom signed a Sh140-million-a-year deal with Kenya
Rugby Union in 2013 to sponsor the local Sevens circuit (Dala
Sevens, Christie Sevens, Kabeberi, Driftwood and Prinsloo
Sevens) under the Safaricom Rugby Sevens Series banner.
Last year, the sponsorship agreement was renewed for a
further three years.

The mobile giant also sponsors the Safaricom Athletics Series,
which last year saw Sh47.5 million poured into 15 Athletics
Kenya and community races, in addition to funding national
trials and events such as the Sportsman of the Year gala
(Sh12 million in 2013).

“I can’t think of any solid corporate leader that wants to get
into space where you don’t have control over how your money
is spent. It’s not my own, it’s my shareholders’ money ...we
are custodians of shareholders’ money and I can’t think of any
sponsor who wants to get into activities where unethical
behaviour continues,” said Collymore.

Safaricom’s football sponsorship is limited to stadium,
security and team welfare matters thanks to the management
woes that dog the sport.

An attempt to fund a youth football tournament, Sakata Ball,
was scuppered in 2012 — after two successful outings in
which the mobile giant spent Sh130 million — when FKF
demanded 20 per cent of the sponsorship money.

The company has now ventured into sponsoring arts and
medical campaigns. Last week, the telco sponsored a jazz
festival in Nairobi.

Safaricom will not sponsor any federation until they
demonstrate proper management of the funds that are
allocated to them, the CEO said.

“There are things that demand our money; a lot of things are
demanding our money. We will move money to the federations
provided that people can demonstrate they know how to
manage it.”

Collymore said sport is important and once the federations
come clean, they will get behind them.
