Raila proposes major changes to country's system of Governance

National Super Alliance (NASA) leader Raila Odinga on Wednesday proposed major changes to the country's system of governance.

While delivering the keynote address at the 2018 Devolution Conference in Kakamega , Raila hailed the successes of devolved units over the past 5 years before highlighting threats to devolution that he maintained must be addressed.

He noted that while several counties had come together to form economic blocs, the current structure of devolution needed to be revised to ensure the units were economically viable.

The opposition boss then proposed a new 3-tier system that borrows elements of the 2005 Bomas draft constitution but retains the current counties along with the national government.

"We need to bite the bullet and revisit the structure of devolution. The Bomas draft had 14 regions and the intention was to have units that were economically viable. It is time to look at how to recover this system.

"I propose a 3-tier system that retains the counties, creates regional or provincial governments and retains the national government with a clear formula of revenue sharing," he declared.

The Orange Democratic Movement (ODM) party leader was one of the key proponents of devolution and is credited with vouching for the system as it exists in the 2010 constitution.

Speaking at Kakamega High School, he highlighted noticeable development brought about by devolution in counties such as Makueni, Wajir, Kisumu and Kirinyaga before tearing into county officials and elected leaders for using their positions to enrich themselves.

He noted that many Governors, County Executive Committee (CEC) members, Members of County Assembly (MCAs) and other county officials were accused of engaging in high-level corruption and misusing public resources.
Raila Odinga being welcomed to the 2018 Devolution Conference by Council of Governors Chair Josphat Nanok

"This corruption network is eating devolution from inside out, the greatest gift we have bestowed on ourselves since independence. The Ethics and Anti-Corruption Commission (EACC) should conduct proper lifestyle audits," Raila stated.

He asked the governors to support his Memorandum of Understanding (MoU) with President Uhuru Kenyatta noting that it would also deal with rampant corruption.

"Fighting corruption and shielding devolution are no longer partisan issues. We shall not provide sanctuaries. Very soon, the corrupt will be on their own," he warned.

Encroachment of Mau Forest and illegal logging has come to hit the nation in dismay ~ Hon Soipan Kudate

Encroachment of Mau Forest and illegal logging has come to hit the nation in dismay.

Hon. Soipan Tuya ,Narok County MP brought parliament into attention on the need to conserve and reclaim back the forest and other natural resources without necessarily having to politicize the matter.

Below is her excerpt from parliamentary contributions that she made  on 20th February 2018.

...I rise to support this very important policy on climate finance. The benefits for Kenya from the policy direction we are taking have been spoken to by the people who have spoken before me.

First and foremost, the issue of protecting our environment and dealing with the adverse effects of climate change is a direct protection and safeguard of some of the very critical principles of our Constitution of 2010, key of which is the need for us to have a certain minimum threshold of forest cover in our country.

Currently, statistics are very dismal. I know we are below two per cent yet the threshold we have set for ourselves, as a nation, stands at 10 per cent. This Policy will go towards supporting our Vision 2030 in terms of increasing our adaptive capacity and resilience to climate change. It is very promising to see that this is a policy that will guide us into a pathway where we will be talking about the need to mobilise both domestic and international climate finance resources and increase financial flows towards mitigating the effects of climate change in Kenya.

When we talk about climate change, the speaker before me has stated clearly, and I could not agree more, that the adverse effects of climate change have no choice of who to hit. In fact, the saddest thing for me in this country is the fact that the matter is trivialised into a political issue every time we talk about protecting our natural resources.

Speaking from my backyard in Narok County, we have the Mau Forest. Some pictures of the forest were circulating in social media two days ago. I know this kind of policy arose from an assessment which was done through the Inter-Governmental Panel on Climate Change. But we do not even need to do assessments to know that we are standing at a very dicey situation. As a country, as a nation and as a partner within East Africa, Africa and the world, it saddens me that when we talk about the need to protect our natural resources, these issues are trivialised.

People begin to talk about politics. When we talk about protecting the Mau Forest, people think we are hitting at one person. We have been told here and it is very clear for all of us that when the Mara River dries, the situation will be bad. I was going to talk about the picture that is circulating even today in social media. The Mara River has dried up and the impact of this is diminished food security. This will not affect one community only. It does not even just affect people who are living next to the Mara River, but affects every individual. We know the Mara River. I am just giving this as an example because we have been given examples of so many other water bodies
which are drying up. Some of them are swelling up due to siltation and rising levels of the sea.

This one is going to eat into all of us. We will have nowhere for our kids to grow in.I want to support this Policy very boldly and say that most of the resources that we are going to mobilise, both domestically and internationally or from whichever sources, should be pumped into reaching out and doing the simple things that are going to contribute towards increasing our forest cover, even before we talk about the big terminologies of carbon cover and many other things.

We need to go back to the basics of what is happening to our forests. When you fly over some of our critical water catchment areas, you will be hurt. It is very devastating.

In terms of the adverse effects that have been spoken about like droughts and floods, we do not need any assessment to know they are happening in our country.

From my village, I cannot remember the last time I saw rain yet we were able to predict when the rains would come in the past. Farmers would plough their fields in anticipation of the rains. They would very precisely know that the rains would come at a particular time. That has a ripple effect in protecting the food security of our country. We can no longer plan for that because our rains are unpredictable. Our water sources have diminished. Even the quality of our water has diminished.

It is time Kenyans woke up and smelt the coffee and knew that we have no place for our children to grow. Even as we support this kind of policy, we should really follow through its implementation.

I want to agree with what Hon. Wamalwa said to the Departmental Committee on Environment and Natural Resources and our newly appointed Cabinet Secretary.Mine is to challenge them.
This is an issue of priority if we are talking about putting our priorities clearly as a country. We need to protect our natural resources. They should wake up and address the issue of climate change as top priority.

When it comes to issues of health, there is increased cost of health because of the adverse effects of climate change. This will affect everybody. It will not matter where you come from or your political affiliation. It will affect all of us. When we talk about reduced agricultural production, this affects our livelihood. It is the mainstay of the Kenyan people. It will not choose where to hit. It will hit all of us.

When we talk about the decline in the quantity and quality of water, it will affect all of us. It is obvious that all these things have a cost implication on our Government.

As I speak, the Government has to devise means and ways to mitigate food shortages. It must address how to mitigate all these adverse effects of climate change. This is a burden which
is going to hit on the table of every Kenyan.

With those few remarks, I support this Policy and really want to see how this will be followed through in terms of implementation. Kenyans must go to the basics. One Member said
that we need to even teach our children about the small habits and practices that will promote the protection of and care of our environment. We have been told here, which is very true, that nature can be very unforgiving, but it has a way of coming back to eat into all of us....

High court in Narok uphold the election of Emurua Dikirr MP Johanna Ngeno

The High Court in Narok has validated the election of Johanna Ngeno as Emurua Dikirr MP.

High Court judge  dismissed a petition by David Keter who was on jubilee Ticket, one of the candidate during the August 8 general election.

Mr. KETER wanted the elections nullified on grounds that it was marred by irregularities and illegalities and voters were coerced to vote against their will. He said there were many cases of bribery, violence and intimidation.

But in his three-hour ruling, High court judge ruled that the MP was validly elected and the elections were held in a credible manner and in compliance of the constitution.

“The petitioner did not submit sufficient evidence. No evidence of such deliberate intimidation & violence. The petitioner’s application has no merit and is hereby dismissed,” said the judge.

The petitioner was slapped with KES 3M suit cost.

Governor Samuel Ole Tunai welcomes the voting of Maasai Mara as Africa's leading National Park

Narok Governor Samuel Tunai and tourism stakeholders have welcomed the voting of Maasai Mara National Reserve as Africa’s leading national park at the World Travel Awards 2017.

Mr Tunai on Friday said the award would be a boost to the tourism industry. The reserve and two lodges; Sarova Mara Game Camp and Fairmont Mount Kenya Safari Club in Olare Orok conservancy were voted as Africa’s best during an event in Kigali, Rwanda, on Tuesday evening.

The event was attended by travel and tourism players from across the world. WINNER The Mara overcame fierce competition from Kruger National Park in South Africa, Serengeti National Park in Tanzania, Central Kalahari Game Reserve in Botswana, Kidepo Valley National Park from Uganda and Etosha National Park in Namibia.

Mr Tunai said the Mara success story has been achieved after the county government rolled out new regulations for the efficient management of the reserve to attract high-end tourists.

MANAGEMENT

He said his government has perfected strategies on how to manage resources effectively while ensuring tourists get value for their money.

“When we inherited this resource from the now defunct Narok and Transmara County councils, it had a lot of challenges such as mismanagement, mushrooming of lodges, poor infrastructure, tax evasion and poaching, which for the last five years we have reversed,” Mr Tunai said in a phone interview.

“It is a great day for the Mara as our tourist attraction sites and lodges have scooped some prestigious awards on the African continent. "It is a confirmation that travel agents from around the world have confidence in the Maasai Mara and Kenya as a tourist destination,” the elated Mr Tunai said.

MARKETING

The governor noted that the awards would boost tourism recovery marketing campaigns in international tourist source markets. He said the awards are also likely to help woo back holidaymakers from Europe and the US.

“It is good news for the tourism sector in Narok. My county government will continue to conserve the reserve to help woo more holidaymakers from around the world,” he said.

WASTE WATER

Sarova Hotels Resorts and Game Lodges was crowned Africa’s leading hotel brand while Fairmont Mount Kenya Safari Club bagged the Africa’s leading hotel award. The award came a day after the Sarova Mara Game Camp won two coveted environmental trophies from World Wide Fund for Nature (WWF) Kenya. The hotel was pronounced winner of the Waste Water Management 2017 and the 1st runners up of the Waste Oil Management 2017.

CUSTOMER SERVICE

The hotel’s manager Kioko Musyoki said the facility will continue to supplement best tourism practices in the Mara and give its best to guests and revellers. “This is a very proud moment, not just for Sarova hotels but for the hotel and hospitality industry in the country. The double victory will strengthen Sarova hotels’ position,” Mr Kioko said.

Something must be done on our schools, we must act- Governor Tunai

Narok Governor Samuel ole Tunai has ordered the formation of an education taskforce to establish why schools in the county perform poorly in national examinations. The governor has expressed his displeasure with the results posted in 2017 KCSE and KCPE exams by schools across the county. The decision to form the taskforce was reached during a one-day education stakeholders’ meeting at the Maasai Mara University where boards of management, headteachers, parents’ representatives, directors of education, county representatives of the Teachers Service Commission, CEC for Education and leading practitioners in the education sector agreed to improve performance in the county. “We have to do whatever it takes to turn around performance in national examinations. The future of our children depends on education so we cannot take chances with academic excellence,” said Mr Tunai. MAJOR PROBLEM He added that the results point to a major problem in the sector because even those schools that used to be academic giants have sharply declined in performance. The 10-person taskforce was mandated to carry out a quarterly assessment of schools, make sure all schools enhance accountability of teachers and students, recommend modalities of benchmarking, approaches for motivation of teachers and students as well as a needs analysis of schools. UNIVERSITY GRADES Governor Tunai expressed dissatisfaction that 459 students (7.71 percent) out of the 6,479 students who sat KCSE exams in 2017 qualified to go to university. An analytical presentation of the 2017 KCSE exam scores by the County Quality Assurance Officer Moseti indicated that no student attained an A grade, with 5,012 which represents 77.8 percent scoring grade D+ and below. In the proportionate percentages, he said, 292 out of the 3,783 Boys (7.7%) and 170 out of the 2,655 girls (6.4%) passed their exams. NEGATIVE DEVIATION From the 2017 exam results, the county recorded a negative deviation from 3.16 to 3.0. “All the sub-counties recorded a negative deviation except Transmara East that recorded a marginal improvement of 0.004 and 63 schools recorded a positive deviation while 66 declined,” said Mr Moseti, adding that no school had recorded a positive deviation in the last three years. Narok Senator Ladema ole Kina called on all stakeholders in the education sector to help transform students and pupils in the county. “We are worried [by] the high percentage of failures in our villages and (this) might soon be a security threat,” said the senator. Nominated MP David ole Sankok caused laughter when he called on the Education Cabinet secretary to transfer all high school teachers in the county, terming them as the source of the dismal performance in national examinations.

One Man injured, lorry burned after two community clash in Isinya

By KURGAT MARINDANY

A 'little' quarrel between two people at Isinya town, Kajiado on Saturday blew up into a fully-fledged battle leaving several people injured and property destroyed.

Trouble started after a local disagreed with the owner of an agrovet shop over the price of an item.

Peter Leken, who was nearby, said the shop owner, whom he only named as Hillary, slashed the customer on the head with a machete. When the customer called for help from passersby, Hillary is said to have dashed off and ran towards Insinya police station.

He was rescued by police officers on patrol who took him to the police station. After some thirty minutes, more than 100 Maasai morans descended into the town and demanded to be handed over the suspect so they could discipline him. The police blocked them from accessing the station. The morans later went to the suspect's shop and set his truck which was full of hay on fire. They also burned down the shop into ashes as others burned hay stocks placed on the roadside along the Isinya/Kiserian route.

The irate morans engaged police in a fight in their quest to have the suspect released to them for lynching. Others went to the town’s slaughter house to smoke out the trader's community members accusing them of disrespecting the natives. Police officers led by Isinya OCPD Stephen Weda contained the situation. Kajiado acting county commissioner David Kipkemei urged the residents to desist from violence and handle their differences using the right channels.

Area MCA Joshua Olowuasa said: "That was a difference between two individuals who should carry their own cross." "The person who was injured should have reported the matter to the police so the suspect can be charged in a court of law."

US call South Sudan president Salva Kiir "Unfit Partner"

By KEVIN J. KELLEY

The United States signalled a sharp shift in its South Sudan policy on Wednesday as Washington's United Nations envoy denounced the country's president as “an unfit partner.”

UN Ambassador Nikki Haley also abandoned the gentle cajolery previously employed by the US in its appeals to neighbouring states to facilitate an end to South Sudan's civil war.

“It is past time for the leaders of Uganda and Kenya to get involved and put pressure on President Kiir,” Ambassador Haley declared in a stinging speech to the UN Security Council.

“They are key players in the success of a true peace process.” Decrying frequent violations of a December 21 ceasefire agreement, the Trump administration's UN representative warned, “It’s not just a lack of forward momentum; things are going backwards in South Sudan.”

INVESTEMENT

Ambassador Haley's comments serve to distance the US from the government of a country whose birth in 2011 had been midwifed by Washington. Successive US administrations — Republican and Democratic alike — had aided South Sudan's fight for independence and had financed its attempts at political and economic development.

Ambassador Haley noted in her speech that the US has “invested well over $11 billion in South Sudan and the government of President Kiir.”

“We have treated the Kiir government as a partner in this effort, and we have assumed that the best interests of the people were its priority,” the US envoy recounted. But through its recent actions, “the government of South Sudan is increasingly proving itself to be an unfit partner for this Council and any country seeking peace and security for the people of South Sudan,”
Ambassador Haley declared.

She cited continued moves by the government to block deliveries of humanitarian aid. These include imposing fees of up to $7.6 million on aid groups, Ambassador Haley said, suggesting that this money should be used to shelter two million internally displaced persons or to feed some of the six million South Sudanese facing famine.

“Our attempts to ease the suffering of the people of South Sudan aren’t working,” she continued.

“And what’s worse, we’re failing; not despite the leadership of South Sudan, but because of it.

The time has come to acknowledge the hard reality that the leaders of South Sudan are not just failing their people, they are betraying them.” The envoy reiterated the Obama administration's calls for an arms embargo on all sides in South Sudan's conflict.

But while the United Kingdom voiced support for that action on Wednesday, two of the Security Council's other veto-wielding members —China and Russia — did not endorse an arms embargo. France, the fifth veto power, has supported an arms embargo in the past. Despite her explicit condemnation of the South Sudan government, Ambassador Haley vowed on Wednesday that “the United States will never give up on this effort” to make peace.

UN diplomats were left to wonder what new actions the Trump administration might take as it revises US policy on South Sudan.

Two men facing life imprisonment for being in possession of elephant tusks

By Robert Kiplagat | Thursday, Jan 25th 2018 at 13:53

Two Maasai Morans fined Sh20 Million each or serve life imprisonment by a Narok Court after they were found guilty of being in possession of two elephant tusks weighing 10 Kilograms valued at Sh1 Million.

The duo Ndare Ole Koshal and Julius Kituber Sopia were arrested by Kenya Wildlife Service (KWS) officials on January 7, 2015 at Impiro village in Loita area Narok South Sub County while hiding in a Manyatta.

Narok Chief Magistrate Wilbroda Juma found the two guilty after the State Counsel produced three witnesses while the accused through their advocate also produced three witnesses in defense.

KWS officer who testified told the court that on the material day, the officers got information from the members of the public that an elephant had been killed in the area prompting eight officers to respond immediately.

Upon reaching the scene, the officers found a carcass of an elephant with both tusks chopped off.

The members of the public led the officers to the huts where the suspects were hiding and when they arrived, one of the suspects, ole Koshal, came out of the hut and threw a spear targeting one of the officers but fortunately missed the target.

When the officers entered in the manyatta, they found the second suspect whereby the two were arrested and taken to Narok Police station.

A search conducted in the house netted two elephant tusk each weighing five kilograms, 10 arrows, two spears, three bows and two maasai swords believed to have been used by the two to hunt down the jumbo.

But while giving their defense, the accused persons said at the material day, they were not in the said manyatta as they had relocated to another area.

In her judgement, Ms. Juma said the prosecution evidence was very consistent and is believable that the two accused persons were in the same house.

“There is no doubt that the accused persons were found in possession of the tasks as evidence given by the second accused wife (Sopia) shows that he was in the said house at the time of arrest,” he said.

In mitigation, the accused persons said they have young families and that they are the bread winners of their extended families praying to the court to pardon them. The magistrate said she take into consideration that the two are first offenders, they have dependents but the law treats the offence very serious and the set minimum term is life imprisonment.

However, she reminded them of their right to appeal in 14 days.

Narok women Rep. Hon Soipan joins other leaders in finding a solutions on wrangles between SGR and Narok East residents.

Narok able women representative joined other elected leaders at Suswa to discuss and find lasting solutions to a myriad of issues between the residents of Suswa in Narok East and the China Road and Bridge Corporation(CRBC).

The SGR project is a flagship of the Jubilee Government expected and indeed intended to raise the livelihood standards of all Kenyans and even more, those Kenyans whose lands the SGR will cut through...it is therefore outrageous and unexpected for CRBC to want to confine these local communities in Narok to the back burner in matters of employment, tendering and coordination of the project.

The countless benefits of the SGR must be maximized and shared equitably within local communities and the relationship between thecommunity and CRBC should be one of collaboration, trust, and respect to avoid effects of adversarial confrontations like the recent loss of life of a young man in a demonstration: the Police and administration should be facilitators and not an impediment.

It is incumbent on all actors to work together as a team and embrace the SGR project which will undoubtedly be of immense value to the people of Narok County once completed.

KANU disappointed as Uhuru nominates Gideon Moi’s rival for top job.

Has KANU been shortchanged in Uhuru's cabinet appointments?

Gideon Moi and his Kenya African National Union must have been left disappointed after president Uhuru Kenyatta failed to name his allies in his Cabinet on Friday.

The president instead picked Moi’s rival Simon Chelugui, giving him a Cabinet slot to head the ministry of Water and Sanitation.

Chelugui who ran on a Jubilee party ticket gave Gideon Moi a run for his money in the Baringo senatorial race with their supporters clashing repeatedly.

Although Moi emerged victorious in the race, Chelugui who is a close ally to Deputy William Ruto commands massive following and should he endorse Ruto for 2022 then Moi will lose significant support in his Baringo home turf.

Earlier on, KANU Secretary General Nick Salat admitted to a local Newspaper that the party had indeed submitted a list of nominees to the president to be considered for slots in the Cabinet.

The list reportedly included Nick Salat, Kiprono Kitony among others who are affiliated to the Baringo Senator.

KANU was eyeing slots after entering a pre-election pact with Jubilee party that saw the party support Uhuru Kenyatta’s reelection bid.

Media reports also indicated that nomination of cabinet secretaries was threatening to tear Jubilee Party apart with William Ruto’s allies strongly opposed to the inclusion of politicians/people allied to KANU in the new cabinet.

Both Moi and Ruto have expressed interest in the 2022 presidential race and are consolidating their support in readiness for 2022.
